Superfund Amendments and Re-authorization Act (SARA) of 1986 and the Emergency Planning and Community Right to Know Act (EPCRA) as Title III of SARA regulation require facilities that fall under OSHA 29 CFR 1910.1200 to report (Form R) their Toxic Release Inventory on annual basis if they meet or exceed applicable reporting thresholds for certain chemicals.

Related sections under SARA are:

  • 302 and 303 are emergency planning and notification requirements; Threshold Planning Quantity (TPQ) is in SARA Chemical list;
  • 304 is emergency release notification requirements (spill reporting); Reportable Quantity (RQ)
  • 311 and 312 are chemical inventory reporting requirements with a list of reportable chemicals submitted under section §311 and the Tier II report submitted under §312; “Facility” definition is found at 40 CFR 370 in order to be subject to the section §312 (Tier II) requirements.
  • 313 is the Toxic Release Inventory (Form R – Toxic Release Inventory or TRI); Threshold Planning Quantity (TPQ) is in SARA Chemical List.

Gasoline and diesel fuel are subject to SARA reporting as they are subject to OSHA’s MSDS requirements under 29 CFR 1910.1200. Therefore, if a Gas Station has 75,000 gallons of gasoline or 100,000 gallons of diesel fuel in underground storage tanks, or 10,000 pounds of either in an above-ground storage tank or more on-site at any one time in the previous calendar year they are subject to Tier II reporting. Bulk facilities must continue to report using the 10,000-pound threshold.
